Can you get an expungement while still on probation in Indiana?

On Behalf of | Oct 20, 2026 | Expungements |

In Indiana, you usually cannot file for conviction expungement while you are still serving probation. Most conviction-based expungement requests require you to finish your sentence first, including probation.

When can you file?

The filing date depends on the type of record and offense. Some arrest records may have different rules, but conviction expungement usually requires waiting until probation ends and any other sentence terms are complete.

For many misdemeanor convictions, a waiting period applies after the conviction date. Some felony convictions also have waiting periods that depend on the offense and when the sentence ends.

What else must be true?

You may need to meet other rules too. These can include:

  • Paying required fines, fees and restitution
  • Having no pending criminal charges
  • Avoiding new convictions during the waiting period
  • Filing in the correct county or counties

If you have convictions in more than one county, you may need separate petitions.

Why probation matters

Probation is part of the sentence, so finishing it is often a key step before you can ask for expungement. Even after probation ends, you still need to meet Indiana’s timing and eligibility rules.

What should you do next?

Start by reviewing your record and checking the date probation ends. Then look at the offense type, waiting period and filing rules that apply to your case. An Indiana attorney can help you see whether you are eligible now or need to wait longer.
